NON-DISCLOSURE AGREEMENT, TERMS AND CONDITIONS OF USE AND ACCESS

The website and/or offline/online platforms, learning management systems, mobile applications, WhatsApp groups, digital content, printed materials, test series, video lectures, and all other associated or ancillary services (collectively, the “Platform”) are owned and managed by KV Academy, a coaching institute for Intermediate education, having its principal place of business at Malakpet, Hyderabad, Telangana, India (hereinafter referred to as “KV Academy”, “we”, “us”, or “our”).

For the purposes of these Terms and Conditions of Use and Access (“T&C”), the Platform together with all study materials, notes, videos, live or recorded classes, tests, assessments, doubt-clearing sessions, counseling, and any other educational services provided by KV Academy shall be collectively referred to as the “Services”.

By accessing, enrolling in, or using any part of the Services, you acknowledge that you have read, understood, and agree to be bound by these T&C, our Privacy Policy, and all applicable laws.

TERMS SUBJECT TO CHANGE

1 KV Academy reserves the right to modify, amend, or update these T&C at any time without prior notice.
2 Continued access or use of the Services after any such change shall constitute your acceptance of the revised T&C.
3 Users are encouraged to review these T&C periodically.

ELIGIBILITY

1 You represent and warrant that you are legally competent to enter into a binding contract under Indian law.
2 If the Services are used by a minor, the parent or legal guardian expressly consents to such use and agrees to be bound by these T&C on behalf of the minor.
3 If you are acting on behalf of an institution or organization, you confirm that you have the authority to bind such entity.

INTELLECTUAL PROPERTY RIGHTS

1 All content including lectures, notes, PDFs, videos, audio, test papers, branding, logos, trademarks, designs, and software (“Academy Content”) are the exclusive intellectual property of KV Academy.
2 Academy Content is provided strictly for personal educational use only.
3 You shall not copy, reproduce, distribute, resell, publish, upload, transmit, or commercially exploit any Academy Content without prior written consent.
4 Unauthorized use may result in legal action and termination of access.

USER ACCOUNT, LOGIN & SECURITY

1 Certain Services require account registration. You are responsible for maintaining confidentiality of login credentials.
2 You are fully responsible for all activities conducted through your account.
3 KV Academy shall not be liable for losses arising due to unauthorized access caused by user negligence.
4 Deleting an app or leaving a WhatsApp group does not automatically terminate enrollment or account access.

COMMUNICATION CONSENT

1 By accepting these T&C, you consent to receive calls, SMS, WhatsApp messages, emails, and notifications regarding classes, updates, marketing, and administrative purposes.
2 You confirm that the contact details provided by you are accurate and belong to you.
3 You agree to update KV Academy in case of any change in contact information.

USER CONDUCT GUIDELINES

1 You shall not misuse the Services or engage in unlawful, abusive, or disruptive behavior.
2 Recording, screen-capturing, or redistributing classes or materials is strictly prohibited.
3 Any activity originating from your device shall be deemed to be initiated by you.
4 KV Academy may suspend or terminate access for violation of these guidelines.

 ACCURACY OF MATERIALS

1 Educational content is prepared with due care; however, KV Academy does not guarantee absolute accuracy, completeness, or exam success.
2 Content may be updated, modified, or removed without notice.

USER-GENERATED CONTENT (IF APPLICABLE)

1 If you upload or share content (assignments, messages, feedback), you confirm that it does not violate any law or third-party rights.
2 KV Academy reserves the right to remove any content deemed inappropriate.
3 User-generated content remains the property of the user, subject to platform usage rights.

THIRD-PARTY LINKS

1 Any external links shared are for convenience only.
2 KV Academy is not responsible for third-party websites, services, or content.

FORCE MAJEURE

KV Academy shall not be liable for failure or delay caused by events beyond its control including natural disasters, pandemics, government actions, power failures, or internet disruptions.

FEES, PAYMENTS & REFUNDS

1 Fees once paid are non-refundable and non-transferable, unless explicitly stated in writing.
2 No refunds shall be provided for missed classes or early discontinuation.

INDEMNIFICATION

1 You agree to indemnify and hold KV Academy harmless against any claims arising from misuse of Services or violation of these T&C.
2 This clause shall survive termination.

WARRANTIES DISCLAIMER

1 Services are provided on an “as is” and “as available” basis.
2 KV Academy does not guarantee exam results, ranks, or admissions.

LIMITATION OF LIABILITY

1 KV Academy shall not be liable for any indirect, incidental, consequential, or punitive damages.
2 Liability, if any, shall not exceed the fees paid by the user.

CONFIDENTIALITY & NON-DISCLOSURE

1 Users shall not disclose confidential information including teaching methods, materials, business processes, or student data.
2 Breach of confidentiality may result in legal action.

SEVERABILITY

If any provision is held invalid, the remaining provisions shall remain enforceable.

TERMINATION

1 KV Academy may suspend or terminate access without notice for violation of these T&C.
2 Upon termination, all access rights cease immediately.

WAIVER

Failure to enforce any provision shall not constitute a waiver of rights.

ASSIGNMENT

1 Users may not assign rights under these T&C.
2 KV Academy may freely assign its rights.

UPDATES

1 KV Academy may update its systems, materials, or methods from time to time.
2 Continued use implies acceptance of such updates.

VALIDITY

These T&C remain valid as long as the user is enrolled or accessing the Services.

GOVERNING LAW & JURISDICTION

1 These T&C shall be governed by the laws of India.
2 Courts at Hyderabad, Telangana shall have exclusive jurisdiction.
